2. Products

Photographs and descriptions illustrating the products do not enter the contractual field.

In any case, in case of error, BELLE MISS may be held liable.

The majority of products offered to its customers by BELLE MISS are available in our warehouse.

3. Orders

The minimum purchase is 100 € HT.

Purchase orders generated on the site are considered as proof of the nature, content and date of the order.

After checking the order and the customer's history, BELLE MISS can request the payment of a deposit before preparing the order.

BELLE MISS reserves the right to cancel any order from a customer with whom there is a dispute over the payment of a previous order or a doubt about the relevance of the items provided by alleged customers.

The information given by the buyer when placing the order is binding: in case of error in the drafting of the recipient's details, BELLE MISS can not be held responsible for the impossibility in which it could be to deliver the product.

4. Delivery

The delivery time is 3 working days in metropolitan France, but it will also depend on the payment method you have chosen. Indeed, for payments by check (subject to prior acceptance) or by bank transfer, the shipping of your order will be made only upon receipt of your payment and its validation by the banking organizations.

An order can be paid and withdrawn in store.

In case of delivery, the delivery costs will be indicated on the invoice established after establishment of the final order.

After confirmation of the order, BELLE MISS undertakes to return to its carrier all references ordered by the buyer, within the limits of available stocks.

This carrier is contractually committed with BELLE MISS to deliver the order to the address of the buyer provided by BELLE MISS.

BELLE MISS declines any legal responsibility if the payment of the taxes was not carried out by the customer.

Delivery in mainland France will be made by La Poste (Colissimo, Chronopost) or a carrier of your choice that can take care of the package at our depot.

Delivery is made in the time slot provided by La Poste, by direct delivery of the product to the intended recipient and against signature (in the case of a shipment colissimo or chronopost).

Possible delays do not entitle the buyer to claim damages.

If, at the time of delivery, the original packaging is damaged, torn, opened, then you must check the condition of the items.

If they have been damaged, the customer must refuse the package and enter a reserve on the delivery note (parcel refused because open or damaged).

Are considered as force majeure discharging BELLE MISS of its obligation to deliver, war, riot, fire, strikes, accidents and impossibility to be supplied.

The goods always travel at the risk of the recipient.

The customer must always check his parcels on arrival. The customer has 48 hours to make reservations with the carrier in case of loss or damage.

No delay in delivery can justify the cancellation of the order, give rise to a penalty or the cancellation of the order, unless otherwise agreed by BELLE MISS.

Any order partially delivered or realized can not be canceled.

If the removal of the goods is the responsibility of the customer, the absence of removal after the provision allows BELLE MISS to put the products on sale or, at the choice of the seller, to pronounce as of right and without notice the resolution of the sale after expiry of the term for withdrawal. The transfer of risk and liability for the products sold takes place upon departure from our premises, regardless of the mode of transport and the payment conditions.

 

5. Price

BELLE MISS reserves the right to modify its prices at any time without notice but BELLE MISS undertakes to apply the rates in effect which will have been indicated on the Site at the time of the passage of the order.

The price is expressed in euros and does not include transport or VAT.

This price includes the price of the products, the costs of handling, packaging and preservation of the products.

 

6. Payment

The price charged to the customer is the price indicated on the order confirmation sent by BELLE MISS.

In case of delivery, the customer can pay:
- by check (only from metropolitan France and subject to prior acceptance),
- by bank transfer (all bank charges are the customer's responsibility),
- By credit card (VAD by phone).

The order validated by the customer will be considered effective only when the payment centers concerned have given their agreement. In case of refusal of said centers, the order will be automatically canceled and the customer notified by email.

In addition, BELLE MISS reserves the right to refuse any order from a customer with whom there is a dispute.

A payment will be considered as released only after good recovery.

 

7. Litigation

This contract is subject to French law. BELLE MISS can not be held liable for damages of any kind, both tangible and intangible, that could result from a malfunction or misuse of the products marketed.

The same is true for any modification of the products resulting from the manufacturers.

The liability of BELLE MISS will, in any case, be limited to the amount of the order and can not be blamed for simple errors or omissions that could have continued despite all the precautions taken in the presentation of the products.

In case of dispute, the customer will first contact BELLE MISS to obtain an amicable solution.

Otherwise, the court of Paris has sole jurisdiction, regardless of the place of delivery and the method of payment accepted.

 

8. Minors

BELLE MISS reminds that minors do not have the capacity to contract. Anyone who orders on the site agrees to be of age.

 

9. Warranties

BELLE MISS guarantees that all products are selected and carefully controlled. All our products are guaranteed for 15 days from the day of delivery. In any case, BELLE MISS can not be held responsible for non-compliance with the legal and regulatory provisions in force in the country of reception. The liability of BELLE MISS is systematically limited to the value of the product in question, value at its date of sale.

In any case, the customer benefits from the legal guarantee of eviction and hidden defects (Art.1625 and following of the Civil Code).
Provided that the buyer proves the defect hidden, the seller must legally repair all the consequences (art.1641 and following of the civil code); if the buyer goes to court, he must do so in a "short time" after discovering the hidden defect (article 1648 of the Civil Code).
No guarantee is due when the defect or deterioration results from a case of force majeure. 10. Retention of title clause

In accordance with the law n ° 80.335 of May 12, 1980, the transfer of ownership of the goods delivered and invoiced is suspended to the complete payment of the price (applicable in right of claim even in the event of reorganization or liquidation).

The signature on the carrier's invoice is equivalent to the acceptance of this retention of title, which can not be mentioned. Notwithstanding Article 1583 of the Civil Code, sending (or taking possession) transfers the risk to the customer.

 

11. Nullity of a clause

If any of the clauses of these terms and conditions were null or void, this would not interfere with the application of other clauses.

 

12. Confidentiality rule

BELLE MISS does not disclose information about buyers to third parties.
